Three Tribunal successes in a row for Chris Mallon for June and July
Chris Mallon has secured three successful tribunal outcomes for clients recently.
Last week, Chris represented a multi-branch franchisee of a well-known pizza brand (London South, Abbott EJ presiding). Claims for direct discrimination, harassment, automatically unfair dismissal, breach of contract were dismissed. The claim focused on allegations linked to sponsorship visas.
Chris was previously successful in London Central (Klimov EJ presiding) at the end of June in an age discrimination claim. A claim for direct age discrimination was upheld when the Claimant was passed over for a job at a lending institution for a younger but less qualified comparator.
Chris was also successful in a fire safety themed unfair dismissal case (Bristol ET, Winfield EJ presiding). The Claimant was dismissed after 24 years’ service. He was a caretaker in a block of flats. The ET held the dismissal was outside the band of reasonable responses as the Claimant was not the “responsible person” under fire safety legislation for monitoring and implementing fire safety recommendations that had not been actioned.
