Our members also act for claimants in a range of tortious and contractual claims.

Our insurance work ranges from indemnity and policy issues to consideration of the fine detail of quantifying claims. We handle all manner of claims including fire, flooding and theft claims and advise as to direct and consequential losses including business interruption.

We also have considerable experience in dealing with matters in which it is (or is to be) alleged that an insurance claim was fraudulent.

Our nuisance practice is often insurance driven, with flooding and drainage issues featuring prominently, but we also often act for private landowners. Members of our team frequently appear in the High Court in nuisance actions as well as the Court of Appeal and higher. Our trespass experience ranges from encroachment by neighbours to mass trespass by “persons unknown”.

The professional negligence work this team undertakes concerns all forms of non-chancery claims, for example, surveyors’, valuers’, architects’, financial advisers’ and accountants’ negligence. This work often involves allegations of negligent misstatement; our expertise in deceit claims more commonly involves allegations that non-professionals have taken undue steps to persuade others from their money.

The TCC hears many of the insurance and nuisance claims undertaken by the team as well as professional negligence concerning technical matters.

Members of the team also excel in classic construction and building disputes.

We assist with all contractual issues concerning the supply of goods and services including consumer credit issues and arguments over unfair terms. Our work involves liability for damage caused by defective products to domestic and commercial interests as well as for damage caused by products lost in transit from the supplier. On the other side, we also act in cases where damage has been caused to goods or where businesses are unlawfully kept from the use of their chattels or property.

We act in all manner of civil actions concerning police from the use of unlawful force to wrongful arrest to malicious prosecution.
