Andrew Gurney represented a defendant faced two counts of possession with intent to supply crack cocaine and heroin, alongside multiple driving offences including dangerous driving, driving while disqualified, and driving without insurance.
The incident occurred during a targeted police operation in an area known for drug activity. The defendant was involved in a high-speed chase, after which he was apprehended and found in possession of the drugs.
With two prior convictions for drug supply, he qualified as a ‘three striker’ and was subject to a mandatory minimum sentence.
Andrew Gurney successfully argued that exceptional circumstances applied and that enforcing the mandatory sentence would be unjust. HHJ agreed, resulting in a custodial sentence of four and a half years.
