Convictions in ‘falsely marked baby-feeding devices’ case prosecuted by Paul Ozin KC 
Following a trial at the Crown Court at Crown Square, between April and July of this year, Kenneth Harrison of Bolton, and Medicina Limited were found guilty of fraud offences of supplying medical devices with false CE markings and making or supplying articles for use in fraud. 
A number of devices, including neonatal enteral feeding pumps, gastrostomy “button” devices and blunt fill needles, were supplied with CE markings that were not valid, giving a false assurance to healthcare providers, in the UK and abroad, that the devices met strict safety standards. NHS Trusts put the pumps into use in NHS hospitals across the UK.  The pumps were used in neonatal intensive care units and special care baby units to feed very sick newborn babies directly into their stomachs. The frauds were concealed by the defendants by providing false documents to regulators.
Sentencing and confiscation proceedings will follow.
The prosecution followed a complex investigation by the Medicines and Healthcare products Regulatory Agency (MHRA), described by the MHRA as “decade-long” and “the result of years of detailed investigative work”.
