Our work covers a broad range of commercial disputes from high value contractual disputes to partnership disputes.Â
We are experienced in civil fraud and techniques such as freezing orders where urgent action is needed for the preservation of assets. Our company work includes unfair prejudice petitions, derivative actions and direct claims against directors. We handle issues involving restrictive covenants alleged to bind employees. Our insolvency work encompasses corporate administration, winding up and wrongful trading claims as well as the bankruptcy of individuals; this work often involves consideration of default with mortgages, debentures and other securities and banking issues.
Our property work covers landlord and tenant (commercial and domestic) as well as traditional land law.
We deal with dilapidation claims, claims concerning the construction of covenants (including restrictive covenants) and possession actions.
We engage with boundary disputes, easements and all arguments as to title and dispositions of land including TOLATA and undue influence claims. Where disputes as to title in property arise in a matrimonial or co-habitation context, chambers is able to draw on the strength depth of experience offered by Chancery & Commercial and the Family team.
In addition to proceedings within the County Court, High Court, and higher courts, members of the team have enjoyed notable success before other specialist tribunals including Land Registry adjudicators and public inquiries.
Our trusts, wills and probate work concerns the conduct of trustees and personal representatives as well as the pronouncement for and against wills, the interpretation of wills and consideration of the property in estates and dealings with it. We are experienced in Inheritance Act claims.
We concentrate mostly on professional negligence comprising of actions against solicitors where the underlying facts have a Chancery flavour. This will include allegations of negligence in non-contentious work such as conveyancing as well as the mishandling of Chancery litigation. Members of the team have also assisted solicitors with disciplinary proceedings brought by the Solicitors Disciplinary Tribunal.
The intellectual property work undertaken by the team focuses on issues surrounding confidential information, breach of trade mark and passing off actions.
