James Paterson secures a finding of fundamental dishonesty (‘FD’) in a claim in which the Claimant was found to have deliberately misled his medical expert by failing to declare a previous and subsequent accident. The Court determined that whilst there was some short-lived injury sustained in the index road traffic accident, the Claimant had substantially affected the presentation of his claim in relation to ongoing symptoms. The claim was dismissed by way of section 57 and an enforceable costs order made.
