James Paterson secures a finding of fundamental dishonesty
James Paterson secures a finding of fundamental dishonesty (‘FD’) in a claim in which the Claimant alleged she had fractured her arm tripping on a pothole on land maintained by the Defendant.
The Court determined that the Claimant had, in fact, sustained the injury by virtue of a fall which took place inside her home address. In finding the claim to be FD, the Learned Judge described that the basis of the claim was an untruthful account.
The Claimant was ordered to pay the Defendant’s costs in an enforceable order.
