Sentence in ‘falsely marked baby-feeding devices’ case prosecuted by Paul Ozin KC 

On 23 September 2026, following his trial at the Crown Court at Crown Square, between April and July of this year, Kenneth Harrison of Bolton, was sentenced for his involvement in offences of fraud by false representation, by dishonestly supplying medical devices with false CE markings, and of making or supplying articles for use in fraud. The devices included neonatal enteral feeding pumps, used in neonatal intensive care units and special care baby units to feed very sick newborn babies directly into their stomachs. They were supplied and used in NHS Hospitals and abroad. 

HHJ Timothy Smith sentenced Harrison to 3 years imprisonment suspended for 3 years, together with 175 hours of unpaid work, and a rehabilitation activity requirement of up to 10 days. Harrison was disqualified from acting as a company director for 8 years. In sentencing, the judge stated: "The fact that you acted deliberately and dishonestly to cover fraudulent conduct is a matter of significant aggravation. You were prepared to invite staff, including your own son, to lie and hide your own conduct and regulatory failings”.

Sentencing of Medicina Limited, the company through which Harrison committed the offences, and confiscation proceedings for both will follow.

The prosecution followed a complex investigation by the Medicines and Healthcare products Regulatory Agency.
