Cops, Courts, and Coroners. When the regulator is waiting in the wings?
Fiona Horlick QC and Fraser Livesey both of Deans Court Chambers, held a engaging and stimulating seminar last night at Manchester Art Gallery for ADRL. The seminars focus was dealing with the issues that arise when the lay client is not only in hot water with their regulatory body, but facing criminal investigation, prosecution or is required to provide evidence to the coroner.
Fiona Horlick QC gave a fascinating insight into the tactics and strategy used during the criminal investigation and trial with an eye to subsequent regulatory proceedings.
Fraser Livesey also delved further into this area with some real-world examples where HSE, GMC, CQC or the like are observing and taking notes when the lay client is called to give evidence in the Coronerâs Court as well as acknowledging the difficulty in, âWhat strategy to deploy and tactics to take?â and âWill their evidence be pounced on and expose them to other proceedings?â
