Matthew Hooper secures finding of fundamental dishonesty.
Matthew acted on behalf of Allianz in a claim for personal injury arising from a road traffic accident. The Defendant admitted liability, and did not deny that the accident was capable of causing injury, but put the Claimant to proof as to causation due to concerns as to the evidence presented in support of the claim.
The matter came for trial before DJ Squire sitting in the County Court at Uxbridge. The claim was dismissed with a finding of fundamental dishonesty, with the Judge observing that the Claimant’s evidence was inconsistent and evasive, and he was “simply making it up as he went along”.
The Claimant was ordered to pay the Defendant's costs of the action on an enforceable basis.
