James Paterson secures a finding of fundamental dishonesty (‘FD’) in a claim in which the Claimant was found to have deliberately misled his medical experts about the mechanism of a road traffic accident which occurred whilst he was seated on a bus. The Claimant claimed he had been thrown about on impact and had banged his head against the window causing, amongst other things, Post-Concussion Syndrome and PTSD. CCTV footage from the interior of the bus was found by the Court to show ‘a trivial accident and that the Claimant did not bang his head’. The claim was found to be FD and the Claimant ordered to pay the Defendant’s costs in an enforceable order.
