Colette Renton represented a building cladding company in prosecution by HSEÂ instructed by Cameron Stubbs of Stephensons Solicitors LLP
The HSE prosecuted the company for breaches of regulation 11 and 13 of the Construction (Design and Management) Regulations 2015.
The Company had been tasked with replacing the external cladding at âThe Circleâ development in Liverpool. Following 2 visits from the HSE, deficiencies were pre-dominantly centred around the risk of fire as a result of combustible material that was left exposed whilst the building remained occupied.
Following pleas, mitigation submissions were prepared and the Judge accepted that steps were taken to remedy the breaches in a very short time period, these were not breaches from which the company financially gained and that the Company has made very substantial changes in relation to their health and safety practices.
The company was fined ÂŁ240,000 plus costs.
