Niamh Ingham successfully defends a client charged with 3 counts of being the owner of a dog which caused injury while dangerously out of control.
Following a 4 day trial at Preston Crown Court, during which the Prosecution offered no evidence in respect of one of the charges after cross-examination, the Judge accepted Miss Ingham’s submission that there was no case to answer at the close of the Prosecution case. Miss Ingham successfully ran a ’trespasser’ defence and relied on the case of Robinson-Pierre [2014] 1 Cr App R 22 to argue that there was no causal connection between the actions of the Defendant and the incidents that followed.
