Richard Whitehall in the Court of Appeal in Cable v Liverpool Victoria
Richard Whitehall is in the Court of Appeal today in the case of Cable v Liverpool Victoria, in which the Court of Appeal will consider the test to be applied in cases where a high value personal injury claim has been kept in a low value claims protocol after the issue of proceedings. Richard appeared for the Defendant in this action on the successful application to strike out the claim in 2018 and was successful again on appeal to a circuit judge. He is led by Darryl Allen QC of Byrom Street Chambers in the Court of Appeal. It is hoped that the decision in this case will bring some clarity to the law in this area, which affects a substantial number of cases.
