Negligence Claim against a barrister and a firm of solicitors dismissed
On Monday 1st February 2016 and following a trial on duty and breach over three days in December 2015, the Hon Mrs Justice Elisabeth Laing DBE dismissed a claim for damages brought against a member of the Bar and his instructing solicitors. The case was based on a settlement at court in January 2003 which was eventually set aside on the grounds of lack of capacity, a finding upheld by the Supreme Court in 2014, and on allegations including alleged negligent under settlement. Glenn Campbell of Deans Court was instructed by Mills and Reeve for the solicitors and was led by Jamie Smith QC of 4 New Square.
